• MEMBERSHIP AND ACCESS
    BuyBuddy is a paid, members-only platform that provides subscribers access to Buy One Get One (BOGO) offers from participating partner merchants.

    Access to offers is granted only to active subscribers with a valid and paid subscription.

    • Voucher Usage
      Each subscriber is entitled to a limited number of vouchers per partner per month:

      • Maximum of three (3) vouchers per merchant per month

      • Vouchers are non-transferable and may only be used by the registered subscriber

      • Unused vouchers do not roll over to the next month

    • Redemption Rules
      To maintain fairness and sustainability of the platform:

      • Each subscriber may redeem a maximum of one (1) voucher per visit.

      • Each subscription includes three (3) vouchers per merchant per month.

      • For group visits, additional redemptions may be allowed only if there are other active BuyBuddy subscribers present, each redeeming their own voucher, and subject to the restaurant’s discretion, up to the following limits:

        • 1 voucher for groups of up to 3 persons

        • 2 vouchers for groups of up to 5 persons

        • 3 vouchers for groups of 7 persons and above

    • Splitting bills does not guarantee additional redemptions.

    • No Stacking Policy for BuyBuddy vouchers

    Vouchers and offers cannot be combined with other promotions, discounts, our vouchers. BuyBuddy reserves the right to decline or revoke voucher use in case of abuse or misuse.

    MERCHANT TERMS

    Each partner merchant may have specific terms and conditions, including:

    • Valid days and times of redemption

    • Eligible items or menu categories

    • Blackout dates (e.g., holidays, peak periods)

    Subscribers are responsible for reviewing and complying with each merchant’s terms prior to redemption.

    SUBSCRPTION AND BILLING

    • Subscription fees are billed on a recurring basis (monthly, quarterly, or annually depending on plan)

    • Subscription will automatically renew unless canceled prior to the next billing cycle

    • All payments are non-refundable, except where required by law

    CANCELLATION, REFUNDS, AND BILLING DISPUTES

    • Subscribers may cancel their subscription at any time through their account settings

    • Cancellation will take effect at the end of the current billing period

    • All payments made are strictly non-refundable. This applies to monthly, quarterly, and annual subscription plans

    • For annual plans, cancellation will not result in any refund (full or partial), and access will remain active until the end of the paid one (1) year period

    • No refunds, credits, or extensions will be provided for:

      • Unused vouchers

      • Partial use of the subscription period

      • Failure to use the service

    BILLING DISPUTES AND CHARGEBACKS:

    ·       By subscribing, you agree not to initiate chargebacks or payment disputes for valid and authorized transactions

    In the event of a chargeback or dispute:

    • BuyBuddy reserves the right to suspend or terminate your account

    • All active vouchers and access may be revoked.

    • BuyBuddy reserves the right to recover any outstanding amounts and associated costs

    If you believe a billing error has occurred, you agree to contact BuyBuddy first for resolution

    ACCOUNT RESPONSIBILITY

    Subscribers are responsible for:

    • Maintaining the confidentiality of their account

    • Ensuring vouchers are used only by them

    • Any activity under their account

    BuyBuddy reserves the right to suspend or terminate accounts involved in fraudulent or abusive activity.

    PLATFORM LIMITATIONS

    BuyBuddy acts as a platform connecting subscribers and partner merchants:

    • BuyBuddy is not responsible for the quality of food, service, or experience provided by merchants

    • Dining Experiences, concerns, and disputes must be addressed directly with the merchant

    MODIFICATIONS
    BuyBuddy reserves the right to:

    • Modify offers, partner participation, and platform features at any time

    • Update these Terms and Conditions as necessary

    Continued use of the platform constitutes acceptance of any updates.

    RIGHT TO TERMINATE OR SUSPEND
    BuyBuddy reserves the right to suspend or terminate any account that:

    • Violates these Terms

    • Engages in misuse, abuse, or fraudulent behavior

    • Attempts to exploit platform mechanics

    GOVERNING LAW
    These Terms shall be governed by the laws of the Republic of the Philippines.

    REGULATORY COMPLIANCE

    All promotional offers are conducted in compliance with applicable laws and regulations.
    Where required, promotions are registered with and approved by the Department of Trade and Industry (DTI).
    Details may be available upon request or indicated within the offer.

    MERCHANT RESPONSIBILITY AND CUSTOMER CONCERNS
    BuyBuddy acts solely as a platform connecting subscribers with partner merchants.
    All products, services, pricing, and overall experience are the sole responsibility of the merchant.

    • Concerns or disputes must be raised directly with the merchant at the time of visit

    • BuyBuddy does not guarantee the quality or availability of merchant offerings

    • BuyBuddy shall not be liable for dissatisfaction, damages, or losses arising from merchant service

    OFFER AVAILABILITY
    All offers are subject to availability and may vary per merchant.

    BuyBuddy does not guarantee:

    • Availability of reservations or walk-in seating

    • Availability of menu items

    • Acceptance of vouchers outside merchant terms

    Subscribers are encouraged to check directly with the merchant.

    PARTNER AND OFFER CHANGES BuyBuddy reserves the right to:

    • Add, modify, or remove merchants at any time

    • Change or discontinue offers without prior notice

    These changes do not entitle subscribers to refunds or compensation.

    MISUSE AND ABUSE OF PLATFORM
    The following are strictly prohibited:

    • Sharing or transferring vouchers

    • Attempting to bypass redemption limits

    • Splitting bills to maximize usage

    • Any fraudulent or abusive behavior

    BuyBuddy reserves the right to suspend or terminate accounts, revoke vouchers, and deny access without refund.

    LIMITATION OF LIABILITY

    To the fullest extent permitted by law, BuyBuddy shall not be liable for indirect or consequential damages arising from:

    • Use or inability to use the platform

    • Actions of partner merchants

    • Any loss or dissatisfaction experienced

    Liability shall not exceed the amount paid for the current billing period.

    INDEMNITY
    You agree to indemnify BuyBuddy and its affiliates from any claims or damages arising from:

    • Misuse of the platform

    • Violation of these Terms

    • Disputes with merchants

    FORCE MAJEURE
    BuyBuddy shall not be liable for delays or failure due to events beyond its control, including:

    • Natural disasters

    • Government restrictions

    • System outages

    • Public health emergencies

    PLATFORM AVAILABILITY
    BuyBuddy does not guarantee uninterrupted access to the platform.

    Interruptions may occur due to:

    • Maintenance

    • Technical issues

    • Network disruptions

    In such cases:

    • BuyBuddy shall not be liable for access issues

    • No refunds or compensation will be provided

    • Subscribers should ensure access before visiting merchants

    MERCHANT STATUS AND COMPLIANCE
    Merchants are independent and responsible for compliance with laws.

    BuyBuddy is not liable for:

    • Closure of a merchant

    • Government or legal actions

    • Refusal to honor offers

    BuyBuddy may remove merchants without notice. No compensation will be provided.

    NO GUARANTEE OF MERCHANT CONTINUITY
    BuyBuddy does not guarantee that any merchant will remain on the platform.

    REDEMPTION DISPUTES
    Subscribers should raise concerns directly with the merchant.

    BuyBuddy may assist but does not guarantee resolution or compensation.

    VERIFICATION OF SUBSCRIBER IDENTITY
    BuyBuddy may require identity verification during redemption.

    Failure to comply may result in denied redemption or account suspension.

    FAIR USE POLICY
    Subscriptions are for personal use only.

    Commercial use, resale, or abuse is prohibited. Accounts may be terminated for violations.

    LOST, SHARED, OR UNAUTHORIZED USE
    BuyBuddy is not responsible for unauthorized use of accounts or vouchers.
    All activity under an account is deemed authorized.

    NO CASH VALUE

    Vouchers have no cash value and cannot be exchanged or refunded.

    VARIABILITY OF EXPERIENCE
    Experiences may vary depending on merchant operations, timing, and availability.
    BuyBuddy does not guarantee consistent experiences.

    By way of general guidance:

    ·       Account data is retained for the duration of your active account

    ·       Inactive accounts may be deleted or anonymized after approximately twelve (12) months of inactivity, subject to applicable legal and operational requirements

    ·       Transaction and billing records may be retained for up to five (5) years, or as required by applicable laws and regulations

    ·       Fraud prevention and security-related data may be retained for the duration of any investigation and applicable legal periods.

    Where applicable, certain data (such as transaction records) may be retained for longer periods as required by law or regulatory obligations.

    Once retention is no longer necessary, your personal data will be securely deleted, anonymized, or disposed of in accordance with our internal data retention and disposal policies.

    BuyBuddy is not intended for individuals under eighteen (18) years old.

If we become aware that personal data of a minor has been collected without appropriate consent from a parent or legal guardian, we will take reasonable steps to delete such data and, where appropriate, suspend or terminate the associated account.

    11. Data Breach Notification

    In the event of a personal data breach that poses a risk to the rights and freedoms of data subjects, BuyBuddy will notify affected users and the National Privacy Commission in accordance with applicable laws and regulations.

    12. Data Protection Officer

    BuyBuddy has appointed a Data Protection Officer (DPO) responsible for ensuring compliance with applicable data privacy laws and regulations.

    The DPO may be supported by external legal counsel, including The Law Firm of Chan Robles and Associates, in the performance of data protection and compliance functions.

    We may update this Privacy Policy from time to time to reflect changes in our practices, services, or legal requirements.
